Extending social security coverage for domestic workers

In Argentina, Decree No. 90 of 23 February 2023 amends Law No. 26,844, which establishes the Special Employment Contract Scheme for Domestic Workers (Régimen Especial de Contrato de Trabajo para el Personal de Casas Particulares), and Law No. 24013 (Employment Act), to grant unemployment insurance and access to family allowance benefits for domestic workers.

Similarly, the Decree modified Law 25239, in order to guarantee effective access to social security benefits for workers who work less than 16 hours a week and who, if they did not make additional contributions, would be excluded from access to these benefits. In this way, we are able to ensure equal conditions of access to those of other salaried workers.

At the same time, the periods worked prior to this modification are recognized as time in service for the purpose of accessing social security benefits. This is subject to a fee which will be deducted from the social security benefit received.
